Our developer client needed to provide allocated parking to purchasers of its flats. Some of the spaces were probably going to be lost when another development took place. We drafted the documentation in such a way that the purchasers of the flats would have a new car parking space, when their original was lost because of the development. This meant all of the flats could be marketed with parking available and meant there was no loss of value.
