It pays to seek legal advice on technical points of law rather than making assumptions. Our client asked us to advise whether its tenant was entitled to remove the factory buildings that it had installed on the land owned by our client. Our client had assumed that they could not, but our advice was that they could. This came down to a technical definition of “tenant’s fixtures” and a detailed analysis of the tenant’s obligations in the lease. Armed with our advice, our client was able to negotiate a substantially lower price with its lender from whom it was seeking to obtain a release from the charge. Our advice saved our client approximately £1 million.
