Constructive Dismissal, changing terms and conditions and breach of contract

Constructive Dismissal is when, as a result of the employer’s conduct, the employee feels forced to resign and will then claim that the employer was responsible for terminating the contract. To have any chance of success in a constructive dismissal claim, the employee must be able to show a) a fundamental breach of the employment contract by the employer or b) a series of breaches of more minor nature but with a “final straw event” and not delay in resigning in response to the employer’s breach to avoid being deemed to have accepted the employer’s breach of contract.
